Due to the collection of data used in this analysis from multiple data sources, some instances occur where the USACE ICW file intersects areas of the SJRWMD file classified as "Land", particularly in the vicinity of Hobe Sound. Clearly this is not the real world situation and efforts will be made to resolve these conflicts in the data. At this time, these were the best data available. The text description in 50 CFR Part 226 is always the one, true definition of Johnson's seagrass critical habitat. These or any other depictions are for information purposes only and shouldn't be relied on for regulatory purposes.

Process_Description:
A point layer was created using the coordinates in the Federal Register. Those points were then used to digitize polygons. The polygons were then "clipped" to a detailed shoreline (cb24_det.e00) obtained from St. John's River Water Management District (SJRWMD). Following the clip operation, microstation design files of the ICW and Miami Harbor navigation channels were obtained from the US Army Corps of Engineers (USACE) and converted to shapefiles. The final ICW shapefile was created by using a 62.5ft buffer on either side of the centerline and editing that buffer file to match the widening areas in the vicinity of the critical habitat areas. The final Miami Harbor shapefile was created by digitizing a polygon over the channel edge line work in the design file. An Edit Clip was then performed to "punch a hole" through the Critical Habitat areas where they intersected the ICW and the Miami Harbor navigation channel, thus excluding the federally authorized navigation channels from the Critical Habitat areas. Finally, the data in the vicinity of Miami Harbor in Biscayne Bay were edited visually to correspond to the paper maps in the federal register document. Additionally, all data used were reprojected to match the detailed shoreline. (UTM Zone 17, NAD 83, HARN)

2011/2012 edits to shapefile: (a) Indian River north Sebastian Inlet: The original shapefile from NCDDC used an erroneous vertex in the SE corner. I recreated the polygon according to eCFR 50 CFR 226.213 in 2007. All else OK. (b) Indian River south Sebastian Inlet: OK (c) Indian River Lagoon - Fort Pierce inlet: OK (d) Indian River Lagoon - St. Lucie Inlet: The western coordinates of the original shapefile were on the west side of the ICW, and there were sliver polygons on the west side. I included the ICW in the shapefile, and created one solid polygon. I also redigitized the eastern side along the shoreline using Bing Maps as a background in ArcMap. (e) Hobe Sound: The coordinate in the FR is suppose to be at SR 708, but looking at Bing Maps, it is to the south. I edited the shapefile to continue north to SR 708. I also made one big poly that does not depict the ICW exclusion. The polygon shorelines were also edited to follow the Bing Maps background. (f) Jupiter Inlet: In this area, a point was added to the southern boundary to better define the shoreline. Both the South center and SE points are on land, and the SW corner is in the water. none are at the shoreline. I was instructed to digitize a boundary that followed the shoreline (again, employing heads-up digitizing techniques using Bing Maps). (g) Lake Worth: the original shapefile had a 4 vertice polygon that approximated the shoreline on the south side. I was instructed to digitize the shoreline along the south side using Bing Maps as a guide. (h) Lake Worth Lagoon - Boynton Inlet: There is an error in the rule for this area. The NE and NW coordinates are reversed. Also, the eastern coordinates are in the ICW, so I edited the polygon to go all the way to the coordinates (the shape file does not exclude the ICW). I also redigitized the western edge to follow the Bing Maps shoreline. (i) Lake Wyman: There is an error in the rule for the area. The SW and SE corners are reversed. The original shapefile excluded the ICW, so I redigitized the polygon to extend to the published coordinates. This unit did not follow the shoreline on the eastern side, so I redigitized it to follow the Bing Maps shoreline. (j) A portion of Northern Biscayne Bay, FL: I received a new Biscayne Bay Aquatic Preserve boundary from Florida DEP, Bureau of Survey and Mapping, Division of State Lands (rev. 2010). The boundary is from Section 258.39 (11) Florida Statutes, and Section 258.397. They send me the exterior boundary for the AP. They said that the law for the boundary has not changed, but the boundary is more accurate now. Abstract:
Polygon shapefile that depicts the piping plover critical habitat units on its wintering grounds. This file does not contain those units that were vacated in North Carolina (2004) or in Texas (2006). The Texas areas have been re-designated (2009) and are in a separate file.
The units were created by generalizing or bounding the buffered mapped critical habitat shoreline in an attempt to capture the dynamics of these systems to the recovery date of 2020. Mapped critical habitat shoreline was created by "on-screen"/ "heads-up" digitizing based on 1992-1998 Black & White or Color InfraRed Digital Orthophoto Quarter Quads at 1, 3, or 6 meter resolution.
Note: The GIS file and the associated coordinates are not the definitive source for determining the critical habitat boundaries for wintering piping plover. As noted in the final rule, the textual unit descriptions constitute the legal source for determining the critical habitat boundaries. The areas included within the boundaries of the GIS file do not follow the legal boundaries of the critical habitat designation. See USE CONSTRAINTS for further information.
Purpose:
Final determination of critical habitat on the wintering grounds for the Great Lakes and Northern Great Plains populations of piping plover under court order (Civil No. 1:96-CV02695AER, Civil No. 1:97-CV00777AER).
Supplemental_Information:
Piping plovers (Charadrius melodus) are federally listed shorebirds breeding along the north Alantic Coast, the Northern Great Plains, and the Great Lakes regions. The Great Lakes population is federally listed as endangered, while the Atlantic and Northern Great Plains populations are listed as threatened. Piping plovers are considered threatened on their wintering grounds. In the United States these populations winter along the Atlantic Ocean from North Carolina south, along the Gulf coast to Texas, and the Carribean. Piping plovers spend the majority of the year on the wintering grounds. Due to the difficulty of seperating out the populations of piping plover (Great Lakes, Northern Great Plains, and Atlantic) when on their wintering grounds, critical habitat was designated for all wintering piping plover. Critical habitat are areas considered essential for the conservation of a listed species. These areas provide notice to the public and land managers the importance of these areas to the conservation of this species. It does not afford any special protection or restriction other than where federal funding, permits, licenses, authorizations, or actions occur or are required.

The legal boundaries are verbally described in the Federal Register.
The GIS file, map products and the associated coordinates are not the definitive source for determining the critical habitat boundaries for wintering piping plover. As noted in the final rule, the textual unit descriptions constitute the legal source for determining the critical habitat boundaries. The areas included within the boundaries of the GIS file do not follow the legal boundaries of the critical habitat designation for the following reasons: 1) the waterward boundary of Mean Lower Low Water (MLLW) has not been incorporated into the GIS file because a definitive source for the MLLW line across the entire wintering range was unavailable, therefore, the areas defined by the GIS file are known to extend out into areas of open water that are not utilized by the piping plover and are not designated as critical habitat, and 2) the landward boundary where densely vegetated habitat, not used by the piping plover, begins and where constituent elements do not occur were not digitized and, therefore, areas included within the GIS file may extend landward into areas not designated as critical habitat. Users of the GIS file are cautioned to refer to the final textual unit descriptions provided in the final rule as the definitive source in determining critical habitat areas. Additionally, interested parties are encouraged to contact the Service for a definitive finding of whether a location is within critical habitat (See Technical/Consultative Contacts:).
This geospatial dataset is the final critical habitat units layer for wintering piping plovers. These data are to be used only in the context of the definition and purpose of critical habitat. This primarily relates to Section 7 consultation under the Endangered Species Act. These data may be used for planning and land management purposes. They are not to be used for legal survey use.

This data set was created using Arc/Info 7.1.2 and ArcView3.1 or ArcView3.2a on a Sun ULTRA2 workstation or Windows desktop pc's.
The following processing steps were used to create the critical habitat unit boundaries in ArcView and Arc/Info software: 1). The mapped critical habitat shoreline shapefile or coverage was buffered by the buffering distance (calculated by the sum of: the erosion or accretion rate * years from present to the recovery date + erosion or accretion rate * the number of years from present to the date of the photography + doqq error). 2). The newly created buffer polygons were either generalized or bounded by doing on-screen digitizing. 3). Line defining land and water was digitized by hand or by inputting into the layer. 4). Attributes were added to the layer by either manual entry or by populating from a source file.
